In Delaware bankruptcy court, Pastore LLC successfully dismissed claims filed by one of the nation’s largest mineral mining companies. Pastore LLC represented an investment bank seeking a fee associated with $650 million in construction financing for the project. The mining company attempted to avoid paying this fee by asserting that claims had been discharged in bankruptcy. Pastore LLC also handled the 3rd Circuit appeal, representing the appellee in the case of Mesabi Metallics Co., LLC v. B. Riley FBR, Inc. (In re Essar Steel Minnesota, LLC), 47 F.4th 193 (3d Cir. 2022).
Pastore LLC represents a real estate construction executive in an adversary proceeding in the Southern District of New York related to over $100 million in real estate development financing. The proceeding involves the largest real estate development in Westchester County’s history, exceeding $1.4 billion. The bankruptcy proceedings have been remanded to state court, which has been a success for the client.
Additionally, Pastore LLC has been retained on behalf of multiple creditors in an adversary proceeding related to the Chapter 11 bankruptcy of Miles Guo (also known as Ho Wan Kwok), addressing issues concerning the transfer of money under an Assignment for the Benefit of Creditors in New York pursuant to Article 2 of the New York Debtor & Creditor Law. Guo’s Chapter 11 filing is one of the most significant bankruptcy proceedings currently ongoing in Connecticut, and his case has received substantial attention in the press.
